Sounds like it is still an active case then.  I'm sort of surprised that a "cease and desist" order wasn't issued prior to the release of the new album, since the lawsuit was already in existence.
It is a shame that it has come to this, but music IS a business.   At least at their level.

It's unfortunate that it was me that had to change, because I never wanted to leave the band — it was never my intention; I never wanted the split. I just merely thought that the band really could use a break, because I think the romance was really dying — backstage and between [the members] personally. 25 years without a break is a very, very, very long time and sometimes these relationships need a break from each other to rekindle the flame. So that's all I suggested. And even before I [went on the road] with AVENGED SEVENFOLD, I remember touring with [the progressive rock project] TRANSATLANTIC at the beginning of 2010 and already knowing that something was wrong in the DREAM THEATER world and that I really needed a break from the guys and the whole DREAM THEATER machine. I knew something was brewing and I knew that I was unhappy, and as has been well documented elsewhere, I merely just wanted a break. But unfortunately, those guys [the rest of DREAM THEATER] didn't see it that way and didn't respect my request for time off. It's unfortunate [that it turned out that way]."

Portnoy, who co-founded DREAM THEATER more than 20 years ago, announced his departure from the band in September 2010 while on tour with AVENGED SEVENFOLD. He has since been replaced by Mike Mangini (ANNIHILATOREXTREMEJAMES LABRIESTEVE VAI).

Portnoy played on AVENGED SEVENFOLD's latest album, "Nightmare", following the death of that band's drummer, Jimmy "The Rev" Sullivan, and toured with them for the entire second half of 2010.

DREAM THEATER's new album, "A Dramatic Turn Of Events", was released on September 13 via Roadrunner Records

If he actually tried to do that (and we don't know what he did), the judge probably thought his case wasn't strong enough to block the release. I mean, blocking the release isn't really relevant to his case.

IDK if it's over, but I doubt that he would ever join DT ever again and even if he does, I doubt LaBrie would continue to be in the band; maybe Myung would quit too.

I can see either Petrucci or Rudess or both collaborating with him in the future, maybe in LTE, but not in the near future, at least.

He's almost the New Yorker Roger Waters now (Roger wanted to take everybody off the band, after all, I suppose there's a difference LOL). As Henry has brilliantly put in the past: "nice career move, dick".

It's quite amazing that none here has sided with Portnoy yet. It seems PA is full of reasonable people after all. Or maybe we are all idiots who can't understand one man's long road through suffering and pain.

Worst thing is, when in 25 years Portnoy and DT reunite for one special fundraising-type event, unlike with Waters and Gilmour, nobody will give a damn f**k.

Now where are Charlie Dominici's damn lawyers...

You don't ask a successful, productive band to go on hiatus while you sort things out and tour with Avenged Sevenfold. You don't get pissed when they don't want to. You don't sue your friends and bandmates when you left the band.

The other thing I didn't like is on Facebook he liked a bunch of peoples comments saying LaBrie was jealous of him and stuff, then when he was called out he proceeded to whine saying liking them doesn't mean he agrees. And now, Mike blocked someone I know off his Facebook for liking someones comment against MP. LOL

Really..how is this any different than all the other krapp that happens to celebrities. When lawyers get involved, it always turns ugly.....and nothing ever gets resolved.
And really........I give a grain of salt to whatever gets posted on the internet...Facebook, Tweets, forums.......I doubt we ever will know the real story of what was actually said Sept 2010 between the band members.
 
I don't know any of these people, so I could not say that someone is arogant, childish, immature, foolish...so on. Its their business, company, livelyhood, its how they put food on the table.....and it seems to me that when other corporations are involved so they too get worried about their income stream from a band like Dream Theater and push for legal actions.
 
Bahhh........all will be good in about 2 months....if its not already since this was issued in April.

Some people have expressed concern that the court PDF contains the home addresses of the members of DT. There's not a lot we can do about that, this document is all ove the internet at the moment.

Just saying, we shouldn't have a link to it directly from here. Sure people can search for it themselves; I did. But there are DT haters here. Not that I think anything would happen anyway, but even DTF won't allow a direct link to the PDF file.

Regardless.....I think Neal is much too busy right now to deal with all this online bantering. He is finishing up the mixing on the Live T2 DVD/CD package and another Transatlantic live album.

I am no lawyer, but I thought once on a court document its public knowledge anyhow......I mean you can go to the court and sit in on the hearings if you like.
 
And I am sure you can find their home address on the internet somehow....if u felt the need.

That's ridiculous. The document was made public by a third party, and they had just as much information as we did at the time. All they did was summarize the document, it's not their fault that everyone on the internet got out their jump to conclusions mat. Although I'm personally still unsure about the true situation, and why didn't Mike say that there is no pending litigation right away instead of being coy?

I'm sorry, but you seem to have a gigantic MP bias. He's been a real a****le throughout this whole situation and deserves the flak. He's constantly playing the victim when he brings things upon himself. And about the band saying bad things about him, wow you're really trying hard to even the playing field with this one. MP himself admits that he wants to be the center of attention often. LaBrie said it as well, and it does detract from the bigger picture. Is it the bands fault that he's like this? No. Is it MPs fault he's in this situation? Yes.

Now about me loving Portnoy, I still do love his drumming and he is still amongst my favourite drummers, but I actually preferred Mangini on this album. And yeah I'll admit, he sounded like Portnoy on the album a bit, but I found Mangini showed more skill in the harder spots. Besides, John wrote all the drum parts ahead of time, so you'd think John would be used to playing with MP for 25 years and sort of gets his drumming style in his head.

Dude, I've been ragging on Portnoy for his stage antics and tough guy vocals for years. You guys however are taking it to a whole new level by attacking his character. Look how eagerly everyone was to jump to conclusions in this thread as it was. I'm sure any attorney for someone as high profile as MP would have filed a claim like this regardless of whether MP meant to go through with it or not. No different than Petrucci's lawyer stepping in to contact MP. All I'm trying to say is, no one is exactly smelling like roses at this point, nor does anyone but the band have all the facts and even for them I'm sure it's distorted. But I guess you can't stop people from being keyboard warriors...

Any good drummer will tell you it's all about groove. You on the other hand like to talk about speed this and that. Also people like to bring up the linear fills starting on the octobans down that Mike constantly used, but they made Mangini do plenty of that as well. When it comes down to it I remember the solid grooves on tracks like Blind Faith, but can't remember jack squat of what MM played on ADToE after six or so solid listens.
