because they're power metal, not prog metal.

they're not bad tho.

I would have called them thrash metal, though not the usual crap. They borrow elements of prog and speed metal, but overall the sound seems to owe more to thrash. Whatever the heck they are, they're pretty good.

I really dig Nevermore.The prog metal team is discussing their addition now,to prog related.

If you like Nevermore check out the band Communic.Their Conspiracy in Mind album is superb.

of course they have many many technical elements

and I love everything they have produced so far (including Sanctuary )

I would say no- I see them as Power Metal as well- boderline Death metal- I think their songs are a bit too 4/4ish, and similar to one-another to be considered prog-

Your right about Communic Jody- they are awesome.

I think that Power Metal can be divided into two large groups - simple/mainstream and complex/unusual. Nevermore clearly belong to the second group ...

how could you not see that varying time signatures is an element of prog- esp prog metal?

Yes, it is *one* element - but certainly not the only one. And because of that it is wrong to deduce from a lack of time signature changes (or unusual signatures) that something isn't progressive.

I know many progressive bands that rarely use signature changes (many post rock bands for a start), and some bands with ever shifting signatures that aren't prog (most thrash metal).

^it's a mixture of Power and Thrash. Perhaps it's easier to say on the album level? The Politics of Extasy is a good example of their proggier side, and several songs from all the other albums.
