In my experience the law is usually quite clear but overzealous litigators or govt (depending on who's petitioning) try to derive new meanings by playing with words which is what breaks the system. A law that would be completely unambiguous as if written in binary code would also be cruel and harsh with little room for relief in a case of genuine hardship. But people interpret words in ways that defy common sense to suit their interests and get away with it surprisingly often.

I wonder what Scalia, who supposedly was such a staunch defender of the Constitution, would think of the idiots in the Party that more closely aligns with his way of thinking who want to stop the President from doing what the Constitution empowers him to do.

I could be wrong but didn't one of the justices.. and a conservative one ..call out the Senate today for even considering dodging it's responsibilities.

Retired justice Sandra Day O'Connor called the Senate out. She was a Reagan appointee, but I think that she was fairly moderate.

ahh.. thanks Scott. I should have known better than to even assume it might have been a sitting member.
Though I wouldn't be surprised if privately, behind the scenes, pressure isn't being applied to not play politics with this. They have nearly a whole year, and a full judicial term to go through. It would obviously be a different case or more grey as to wait if this happened in the summer or especially the fall. That said.. who do congress really answer to.. their voters and from the polls I've seen. Which way you feel is highly.. HIGHLY defined by ideology. Interestingly.. moderates are split on the President selecting the new Justice. I suppose the GOP could.. and likely would risk a move. The same voters that put them in office are likely the same ones that could care less about obstruction and not acting.. even as they bitch about how they government is broken. Ignorant Idiots.. |

Personally, I think that the Senate and the President need to do their job and appoint a new Supreme Court justice. And given that the Senate is Republican and the President is Democrat, they need to do what they need to do, and that means compromise and find a moderate that is acceptable to both sides....which quite frankly should be the case on all Supreme Court judges since it is not their job to create law....it is their job to interpret the law. Appointing liberal leaning or conservative leaning judges defeats that check and balance within our system since they are going to rule based on their political ideology...no matter what they might say.

regardless of what anyone thinks of him. The President isn't an idiot..no way in HELL he gives the Senate an easy out and puts out some granola munching extremist from the left that he knows.. as all of do that will NEVER be confirmed..and probably never even given a hearing.
Hell he's a lot smarter than most in Washington. He knows that and how to play the political game. Democrats are pros at letting the GOP let themselves look like spoiled kids throwing a temper tantrum when they can't have their way. He'll appoint a moderate yet well veted to lean the way.. WE who put in office ..want him to lean. That means not using the court to hold to fight what can not be fought..should not be fought.. this country is changing.. and times change.. the country if it wants to even think of remaining great.. must change as well. my two cents of course... |

Obama should embarrass the Republicans to death, nominate someone who is making them look awful when they deny to do their constitutional job. I've like the "I don't give a f**k" version of Obama so much more than the first-term version and I think is something he could do and would be of benefit even as a rebound to the party

It is sad, but in all honesty, the best thing that could happen is that the Republican senators don't do their jobs of confirming a new judge (assuming that Obama puts forth someone who is moderate and palatable to both sides of the aisle) and then come election time, a Democrat is elected president and the Democrats retake the Senate. i.e. the next judge put forth is pretty much the middle finger to the Republicans. It probably won't change a damn thing, but something like that needs to happen to fix our political system. This two party squabbling all the time with no compromising and no doing what is actually best for the people has to end.

Though the idea sounds nice, I would be too terrified of the possibility, even if it was 0.1 % (which is not, it could be much higher) or President Trump or (worse) President Cruz nominating the next Supreme Court Justice.

I read "To Kill a Mockingbird" and all of Eco's novels except "La Misteriosa Fiamma della Regina Loana" ("The Mysterious Flame of Queen Loana"). really a hard blow. my favorite Eco novel is "Baudolino" because in it he brings to life many creatures that were mentioned in the "Physiologus", a widespread book in the middle ages in which all kinds of fabulous creatures which were at that time believed to exist are described Edited by BaldJean - February 20 2016 at 01:17 |
